Addington: Dick Isn’t Part Of Executive Branch, ‘Attached’ To Legislative.

This assertion is clearly ridiculous by Addington. Anything to cover up for Cheney.
Thinkprogress:
In a protracted battle with the National Archives last year, Vice President Dick Cheney sought to avoid submitting records to the archives by claiming that the office of the vice president is not part of the executive branch. During today’s House Judiciary Committee hearing, Cheney’s chief of staff David Addington reasserted that position, declaring the vice president’s office to be a separate entity that “attached” to the legislative branch:
REP. STEVE COHEN (D-TN): Mr. Addington, what branch are we in?
ADDINGTON: Sir, perhaps the best that can be said is that the vice president belongs neither to the executive nor to the legislative branch, but is attached by the constitution to the latter. […]
COHEN: So he’s a member of the legislative branch?
ADDINGTON: No I said he’s attached to the latter.

If Cheney doesn't belong to the executive branch nor the legislative branch, then the judicial branch is left which Cheney is disqualified from that branch. Since Addington says that Supreme Leader Dick doesn't belong to any of the branches but has some kind of separate entity phantom branch, then why is Cheney the President of the Senate? According to GovExec website, Cheney is mention as being part of the Executive branch on the White House and Senate websites.
GovExec reported several more instances of the White House acknowledging Cheney’s executive branch status:
On April 9, 2003: Cheney lauded a recent court ruling, stating, “I think it restored some of the legitimate authority of the executive branch, the president and the vice president, to be able to conduct their business.
On April 14, 2004: speaking in China, Cheney explained that President Dwight Eisenhower first gave the vice president an office “in the executive branch,” adding “since then the responsibilities have gradually increased.”
In 2001, Bush stated: “[w]e know the difference between the Executive Branch and the Legislative Branch, but I do believe the President and the Vice President can play a part, a strong part, in helping advance an American agenda.”
The White House website notes: “To learn more about the executive branch please visit the president’s Cabinet page on the White House web site.” A click on the “Cabinet page” reveals Cheney to be a member of the Cabinet.
