Newsinkling: The Human Tragedy of Deborah Jeane Palfrey. Part XVI.

I had remembered in college of reading William Shakespeare’s play, All's Well That Ends Well. I interpreted the play as a comedy. This play was often called one of Shakespeare’s problem plays because All’s Well That Ends Well cannot be easily classified as tragedy or comedy. In Ms. Palfrey’s case, one can’t interpret her case and her life as a comedy or a tragedy.

Update: I received this on email this past weekend. With all of loss of Jeane, I found out that both prosecutors and Jeane's defense attorney were in mutual agreement to request motion for abatement on Jeane's case. There was no objection to this from the prosecution side. Interesting timing that they filed this the day after Jeane's death on May 1st without putting up a fight. The real question to the government: Was all of the manipulation and lies of bringing this criminal case forefront to both Judge Gladys Kessler [who later recused herself from the case without a logic reason] and Judge James Robertson worth a tragic death to a woman who paid her taxes for 13 years on her business without an audit? And why did the government "quietly" filed this motion for abatement so quickly? Did guilt and shame come to the government's mind in this case?

JOINT SUGGESTION OF DEATH AND ANTICIPATION
OF MOTION FOR ABATEMENT OF PROSECUTION

The United States of America, by and through its attorney, the United States Attorney for the District of Columbia, in consultation with and with the concurrence of counsel for defendant, Preston Burton, herewith files this joint suggestion of death. The parties file this suggestion on information and belief that defendant, Deborah Jeane Palfrey, died on or about May 1, 2008. Once the certificate of death is received, the parties will jointly move to abate the prosecution.

A defendant’s death is a basis for abatement of all prosecution proceedings from their inception. Durham v. United States, 401 U.S. 481, 483 (1971); United States v, Asset, 990 F.2d 208, 211 (5th Cir. 1992) (death of defendant before entry of judgment abates prosecution ab initio); United States v. Oberlin, 718 F.2d 894, 896 (9th Cir. 1983) (similar holding); cf. United States v. Pogue, 19 F.3d 663 (D.C. Cir. 1994) (death pending direct appeal abates prosecution); Howell v. United States, 445 A.2d 1371, 1373 (D.C. 1983) (quoting Howell).

In light of the apparent recent death of defendant and in anticipation of the resulting joint motion for abatement of prosecution, the parties request that the Court stay the need for either party to file any pleadings that are coming due for a response in the interim. Furthermore, defense counsel requests that he be authorized to contact the defendant’s family and representatives of her Estate in[...] connection with matters related to the criminal and civil forfeiture proceedings before the Court. The United States does not object to defense counsel’s request.

Does anyone know the e-mail or court address of the prosecutors. I have no illusions, but nevertheless I would like to send them some questions whether it was worthwhile to have this trial for two people dead in exchance. I think many people should ask them.

Huh? Not quite sure I understand-if they were closed why was she in court in April? The prosecution holds some responsibility for her death...as the fast and quiet abatement shows.

Now they can seal it all up and the Johns are free to roam...the pigs.

Quick action was taken by the Prosecutor because of guilt nothing else. Evil is in the heart of men only a few try to fight it. Without Laws things like this happen all over the world. America holds itself to be better then others while we see we're all the same. Americans use the phase Christian Values as a front while doing no better then those who stood and watched Jesus get killed. Not one Priest or Law Maker stood up to speak out. Americans who read about this case didn't bother to read but followed the Prosecutor's charges and looked forward to this innocent woman, go to jail. The both Judges had a chance to submit Justice but were in the back pocket of the corrupt White House. Heartless greedily Prosecutors who will sell out their own Mothers cheered and laughed when the guilty finding was made in less then 7 hours. Yes a charge that even Judges have to read up on 12 people with no legal knowledge saw as guilty. A tainted Grand Jury with the help of the seating Judge to make sure things went right for the Prosecutor. What happen to Jean Palfrey can happen to any American, but with their heads in the sand they don't even know it.

If Americans had read about how and why the Justice System was formed they would understand we have lost it now. Many played a part in this tragedy and others sit back and watched. America says it's stands with God but forgot what He said. Do unto others as you would want do unto you. We all have to answer to God in the end. I am glad I can say I did what I could to help another human being without looking for reward or a big name to make money off of. Jesus said when you do an inselfest act for someone you get back your reward 7 times. Very few will be rewarded in Jean's case as very few gave from their hearts to help. Jean knew Law as a Paralegal and businesswoman as she saw no way out by the way the Prosecutors had fixed the case and no public support. She knows now that God was already aware of what was going on as he sees everything we do and even the deepest part of our hearts. So many will tell themselves they are sorry for what happen but God sees they never really cared at all.

Because Jeane died before her sentencing, the prosecutors have to wipe her charges and case clean. Therefore, the government and court had to close her case. So, they closed her case dated August 2007, the date the case opened. But, the gov't can't closed the case dated April 2008. Jeane was indicted on March 2007. The prosecutors had to close her case for Jeane's estate. Since Jeane's mother is the responsible person for her estate, nothing can't be pending.

Good question, Anon. Makes you wonder on how in the world all 12 jurors can understand RICO and find her guilty of all charges.

Yes, thank you for the explanation. I did wonder how RICO statutes could apply to her and not to Bushco and friends.

Alot of folks don't really understand Jeane's charges. Many people only went by that Jeane was charged with running a prostitution business and money laundering and not the actual charge of RICO. Jeane's case was the first case of a prostitution case being chanred under federal statures of RICO. Yes, under the federal stature of RICO, prostitution is under the RICO act. However, under RICO, bribing a public official is under RICO. In the case of Brent Wilkes, Wilkes was never charged under RICO. He bribed former Congressman Duke Cunningham. Wilkes may have been charged under the RICO. But, that never had happened because U.S. attorney Carol Lam was targeted for firing in the USA firing scandal. The truth will eventually come out in Jeane's case.

The cat is behind in reading all of the posts. I thought "Newsweek" did a nice job humanizing her in the article that appeared this week. It is probably linked on this blog somewhere already.



May all those who lost their lives in Burma this week be blessed, attain Nirvana, or at least return as someone with a more comfortable existence and less suffering than what they had when they left this world.

Thanks for pointing out the Newsweek article about Jeane. I have been very busy that I haven't got to read much of the articles on Jeane since many of them are exploiting her death as sensationalism. Glad Newsweek gave a human side to her.
