Court appearance for Vito Fossella postponed.

Staten Island's Rep. Vito Fossella won't be appearing in court at the end of the month on drunken driving charges after all.

The Republican congressman's hearing, scheduled for June 27 in Alexandria, Va., has been postponed. A new date for the trial will be set on June 26, with the trial likely to occur in July or the first two weeks of August.

Fossella allegedly had a blood alcohol level of .17, more than twice the Virginia legal limit, after being pulled over by police on May 1.

He faces a mandatory five days in jail if convicted of the DWI charge.
