Appeals court refuses to halt ex-Mayor Kilpatrick probation hearing


The state Court of Appeals today issued a defeat to ex-Detroit Mayor Kwame Kilpatrick’s lawyers and ruled that a violation of probation hearing can proceed in Wayne County Circuit Court.

The appellate court also ruled that Wayne County Circuit Judge David Groner was within his rights to order Kilpatrick to make a $79, 011 payment on his $1-million restitution by Feb. 19. Groner properly ordered Kilpatrick to pay $240,000 within 90 days of a Jan. 20 ruling, the appellate court ruled.

“The trial court did not abuse its discretion by concluding that the assets purportedly belonging to the defendant’s wife would be included in the determination regarding the proper amount of restitution payments,” the court wrote today of Kilpatrick and his wife, Carlita. “The defendant acknowledged that his wife and children did not have income, and all assets were turned over to his wife who was responsible for handling the family finances.”

Kilpatrick testified during previous restitution hearings that he received $240,000 in loans from local businessmen Peter Karmanos, Roger Penske, Dan Gilbert and Jim Nicholson. Read on.
