Siegelman attorney asks Holder to intervene

MONTGOMERY, Ala. (AP) — The chief attorney for former Alabama Gov. Don Siegelman is urging U.S. Attorney General Eric Holder to ask a federal judge to throw out Siegelman's corruption conviction.

Attorney Vince Kilborn mailed a four-page letter to Holder on Friday, saying Siegelman's prosecution was filled with misconduct.

Kilborn says he wants Holder to treat Siegelman's case like he did the case of former U.S. Sen. Ted Stevens of Alaska. Holder on Wednesday asked a judge to toss out Stevens' corruption conviction because prosecutors withheld evidence from his defense team during the trial.

Here is what Holder needs to look into: The judge's conlict of interest for financial gain and the refusal from both judge and prosecution of jury misconduct:

Fact: The Presiding judge, Judge Mark Fuller, a Bush appointee, refused to investigate juror misconduct. Eight e-mails have surfaced post conviction which if authenticated by the judge would require a new trial. The judge has refused to investigate the e-mails.

Representative Davis (D) Alabama: "Let me turn to the Alabama Case.
The former Governor of Alabama who was indicted ....the US Attorney’s
office that prosecuted the case declined to investigate juror misconduct and
indeed sought to exclude the e-mails from even being heard in an
evidentiary hearing. Here is the question: Would you expect a US Attorney
office that had evidence of jury misconduct to investigate the misconduct or
exclude it from being heard at evidentiary hearing? Which is the better
practice, Mr. Gonzalez? "

US Attorney General Gonzales: "As a general matter, the former. But I'm not going to comment on this particular case without looking at the facts."



Motive: The judge is a substantial stockholder (40%) in Doss Aviation Company which was notified of a possible contract award from the United States Government in February, 2006 after Judge Fuller took this case and on May, 2006 during jury deliberations Doss Aviation was awarded a $178 Million Dollar contact renewable annually by the United States. The Judge is listed as the registered agent and the Federal Court House address is used as the address of the Registered Agent for Doss Aviation.

This case should be tossed and a full investigation should be done on all parties including the Judge. Holder has his hands full with so many corrupt cases by the Govenment and the Judges who worked for the Bush White House.
