Judge Robert Colombo Jr. refused Mayor Kwame Kilpatrick’s request to put the Free Press Freedom of Information case on hold and said that the mayor will have to give a deposition in the matter. The judge said he would not have allowed the mayor to join the case if he knew that the mayor’s first motion would be to ask to delay it.
Colombo said the mayor in a deposition cannot assert a blanket Fifth Amendment privilege against self-incrimination, but will have to raise it on a question- by-question basis. In another ruling, Judge Colombo said that Christine Beatty had not given up her Fifth Amendment rights in answering some questions posed by the Free Press in the case. The judge said she is properly exercising her rights by raising it on a question-by-question basis.
