CONRAD Black, the former Hollinger International chairman due to start a 6 1/2-year prison sentence for fraud on March 3, wants his bail extended.
He wants any extension to last at least until a federal appeals court hears challenges to his conviction.
In papers filed yesterday with US District Judge Amy St Eve in Chicago, lawyers for Mr Black argued that jurors erred in July in convicting him on at least two of the four counts for which he faces punishment.
Prosecutors' flawed legal theories invalidate the remaining convictions, the lawyers said.
The jury "had no basis to conclude beyond a reasonable doubt that the defence explanation was untrue or was less likely to be true that the government's speculative theory", attorney Marc Martin wrote of one count.
Mr Black, who led Chicago-based Hollinger for eight years, was convicted for his role in the theft of $US6.1 million from the newspaper publisher.
Prosecutors have until January 29 to answer Mr Black's request, which seeks the continuation of his $21 million bail at least until mid-June.
Mr Martin said the US Court of Appeals would have heard arguments on his appeal by then.
There was no comment from Chicago US Attorney Patrick Fitzgerald's office yesterday.
Two other Hollinger executives with whom Mr Black was convicted also have asked the court to continue their bail until the appeals court decides their cases.
Judge St Eve has said she will rule before their incarceration date.

No way,maybe Boosh will decide the court was too hard on him and commute his sentence too. Yet Gitmo guys are still waiting to hear why they have been held without charges for 6 years.

I don't blame him no one wants to go to jail. Now I hope he doesn't try the trick Ken Lay did by faking his death. To bad Black didn't pay of the White House their always for sale. Well Canada doesn't want him back there, so it's to jail he will go.
Oh and Bush/Cheney said we don't torture we call it love.
