Palfrey Update #24 - Jeane Seeks Subpoenas of Sen. Leahy/ABC's Brian Ross.

Greetings:


Docketed on Monday was Jeane's First Omnibus Motion. This motion seeks twelve (12) separate orders from the Court and during the next few days I will be explaining the salient points of each.Along with the "Honey Pot" defense (discussed in Update #22) and the defense of Outrageous Government Conduct (discussed in Update #23), Jeane is also raising the defense of Politically-Motivated Prosecution. While all extradition treaties that the United States has entered into reserve the right to refuse extradition of a fugitive if the extradition request is "politically motivated", curiously, the jurisprudence of the United States contains no such express prohibition against political prosecutions. Accordingly, Jeane is likely to be make new law as she vigorously asserts the defense of Politically-Motivated Prosecution.The facts supporting the claim of Politically-Motivated Prosecution are four-fold and fully set out in the First Omnibus Motion, but can be summarized as follows:

• A distinguished United States Senator and Chairman of the Senate Judiciary Committee has stated that “Under this Attorney General and this President, the Department of Justice suffered a severe crisis of leadership that allowed our justice system to be corrupted by political influence.” August 27, 2007,
Comment Of Senator Patrick Leahy (D-Vt.). • Baltimore's former United States Attorney, Thomas DiBiagio – whose jurisdiction included part of the operational area of the Defendant's Escort Service and the territory of Agent Troy Burrus of the IRS who investigated this matter – has publicly alleged political influence in his firing to stop his investigation of Republican Governor Robert L. Ehrlich Jr. See Former Prosecutor Says Departure Was Pressured, New York Times, March 7, 2007, attached. • ABC News, which had received a portion of the escort service telephone records, announced shortly before their broadcast on May 4, that “prominent government leaders and Washington figures will be named in Friday night's broadcast.” See: N.P.R. article. Yet the broadcast in fact failed to name a single Washington figure notwithstanding that Brian Ross of ABC News acknowledged: "The phone numbers also track back to Georgetown mansions and prominent CEOs, officials at the World Bank and the International Monetary Fund and lobbyists both Republican and Democratic." Thus, the very real specter exists that political pressure was placed on ABC News to “bury” those names of "prominent CEOs, officials at the World Bank and the International Monetary Fund and lobbyists both Republican and Democratic." • A review of the Washington, D.C. Yellow Pages alone reveals that there are over eighty (80) escort services operating in the D.C. area, but only one has been federally prosecuted -- Jeane's Pamela Martin & Associates. Moreover, the timing of the search of Jeane’s home on October 4, 2006 – coming a few short weeks before critical national elections which would toss the Republican Party out of office – raises the very real specter that the search of Jeane's home was motivated by (i) a hope of finding evidence to discredit Democratic candidates or, as subsequently confirmed, (ii) preventing damaging evidence regarding Republican candidates from being revealed – particularly in Maryland – prior to close elections.

Accordingly, in the
First Omnibus Motion Jeane has asked the Court for subpoenas to require (i) Senator Leahy to testify as to his knowledge of the "corruption" of the justice system by political influence, (ii) Thomas DiBiagio to detail the knowledge he has of a politically-motivated Department of Justice and (iii) Brian Ross of ABC News as to why he suppressed information relating to and what are the identities of "prominent CEOs, officials at the World Bank and the International Monetary Fund and lobbyists both Republican and Democratic."
