While talking about the Scooter Libby commutation on Face the Nation, Sen. Schumer said he talked to Pat Leahy about calling Patrick Fitzgerald in for questioning about Bush and Cheney because they didn’t talk to him in the grand jury setting about the Plame/CIA leak. All legal scholars weigh in please. Can he call Fitz since Bush/Cheney weren’t under oath?
Schumer: I’ve spoken to Sen. Leahy about this and what we’re thinking of doing is calling Patrick Fitzgerald—the prosecutor before us….he did interview the President and Vice President…not before a grand jury and he might have some very interesting things to say.
Commentary: Since Senator Schumer is not an attorney, calling Patrick Fitzgerald for questioning of the interview of Bush and Cheney is useless (yes, we would like to know what Bush and Cheney said to Fitzgerald. Bush's interview was 70 minutes). First, Bush and Cheney weren't under oath with Fitzgerald interviewed them. And both had their attorneys present. Secondly, the interviews with Bush and Cheney would be called heresay and would be inadmissable. Thirdly, Schumer would be opening up a can a worms in legal issues to the attorneys of Bush and Cheney. Finally, Fitzgerald would only come forward to testify if he had to for the Senate or House committee only if he was given a subpoena.

Sen. Schumer doesn't understand law. Fitz is not the answer to the committees questions. They had Gonzo for testimony yet never asked him what he was doing at the Federal Court talking with Judge Walton and the attorneys. Gonzo went to the Court twice about the Libby case. Fitz didn't have the Gerbil or the others snakes under oath. Any thing they said can't be used. I don't want my little angel getting in the middle of the corrupt Administration. If the Senate can't do it's job resign. All the answers are there and the people they need are there use them. Gonzo lied under oath yet Sen. Schumer isn't charging him with a crime. Sen. Schumer needs to talk to an attorney to get legal answers.
Biloxi, they may be called hearsay but I think what they really want to do is pin down motive.
I think they want overall Fitzgerald's facts from the case, and arguments that were made for or against Bush & Cheney.
Whether they were under oath or not, I think its clear that is what they're after.
An overall picture of the whole case, which Fitzgerald at this point is one of main people that can provide it.
I'm sure he would come voluntarily just to set the record straight. Put all the facts out there.
Then if its necessary at all subpoena the case files, and then subpoena the Vice President once and for all.
Put this into court where it belongs and get Cheney out of office.
Don't they have more important things to investigate and waste their time over? We have this war which is costing and costing and no progress is being made, we have Gonzo, .....well the list goes on this should be taken off the list, and on to more important things.

Jackie's right on the Senate. I told peole back in 2003 that the 'reason' to go to war in Iraq was BS. If I knew that sitting in my armchair without access to all of the information that those in the Senate do, then their competance is in question. The Senate should have known better, and voted differently. They got played like a sucker at the used car dealer.

Senator Schumer may not be an attorney but Senator Leahy is.
Out with the truth, the senate should make a deal with Fitzgerald and take the case files.
See what the cover-up comes down to once and for all, then impeach and convict.
From the sound of things they've already been talking.....Lets see they come to an agreement like what was made with Comey earlier.

Anon, I know what Schumer and Leahy want: the interviews of Bush and Cheney with Fitzgerald. But, if Leahy and Schumer gotten the interviews by Fitzgerald, it is inadmissable in a court of law. And lawyers of Cheney and Bush would argue that in court. Because both of they were not sworn under oath by Fitzgerald, it woudln't hold up in court.
Yes, Fitzgerald can come volunarily just Waxman invited Fitzgerald to the hearing on Ms. Plame. But, Fitzgerald declined the offer. And I think if Leahy and Schumer decide to send a letter to Fitzgerald, he will decline the invitation. And yes Fitzgerald is the one to provide that information since he talk them. However, Leahy and Schumer will be risking legal issues with Bush and Cheney's lawyers.
