Judges Sentelle, Henderson and Tatel say the following:
“Upon consideration of the motion for release pending appeal, the opposition thereto, and the reply, it is
ORDERED that the motion for release pending appeal be denied. Appellant has not shown that the appeal raises a substantial question under 18 USC Sec. 3143(b)(1)(B). See United States v. Perholtz, 836 F.2d 554, 555 (D.C.Cir. 1987) (per curiam) (substantial question is one that is “close” or that “could very well be decided the other way”).

On another side note: The three appellate judges based their decision on Libby defense team's argument under U.S. v. Perholtz (finding plain error in improper prosecutorial remarks where there was "a strong case against the defendants" and "any possible prejudice was cured by the trial judge's instructions that arguments of counsel are not evidence"). Judge Walton mentioned the same case in his recent memorandum opinion filing to argue that Libby should be jailed.
Finally,keep in mind that Scooter Libby is being jailed while he is fighting his conviction charges. So, it is not over for Scooter for good until Scooter uses all of his trump card of appeals, turned down on every appeal and is in jail for good!

It's amazing that Libby and his team of lawyers are suppose to be so smart yet they talk about the Supreme Court hearing his matter know the Court wont be back until Sept. Now grant you with the 5 Bush team of Justices Libby might have been a free man as these guys just follow orders given by the White House. Oh well it's off to the poky for the little soldier.
It would be wiser for the Libby team to go to the decider for their request for a stay of the jail sentenced. Yes the decider is Daddy Bush not baby George as we saw this weekend with President Putin's visit. Baby Georgie needed Mommy and Daddy's help. Daddy protected Georgie from big bad man Putin and Mommy baked cookies. Yes Laura earned her 10 million and did as most Stepford Wives do call the Gerbil smart. I was glad Laura chip didn't get stuck and starting repeating herself.
Now all those Libby supporters can give him a big sending off party. I'm sure in Sept. Alito and Roberts will make law and say lying under oath isn't a crime anymore if your a GOP.
MSNBC says Bush just commuted Libby's sentence.
