Update 1:
Mark Steyn July 10, 2007 16:26:56
The jury note previewed below reads:"We have discussed and deliberated on all the evidence and we are still unable to reach a unanimous verdict on one or more counts."They have asked the judge for advice.
Update 2:
Mark Steyn July 10, 2007 16:42:33
With the jury at least partially deadlocked, it's worth reminding ourselves that there are 42 different charges on which they have to reach agreement - 13 charges for Conrad Black, 11 for Jack Boultbee, 10 for Peter Atkinson and 8 for Mark Kipnis. As is traditional, the judge called the jury back into court and told them to go give it another go. She re-read her original instruction and enjoined them not to go along to get along - ie, "not surrender your honest belief". It's not clear which charges are giving them difficulty: Have they decided to acquit Mark Kipnis but are unable to agree on convicting Black, Boultbee and Atkinson? Or have they decided to convict all four on the non-competes but can't agree on Conrad's birthday party for Barbara?
Update 3:
Mark Steyn July 10, 2007 17:04:50
In a second note, the jury has expressed a wish to render a partial verdict. The judge has requested instead that they sleep on it.
Update 4:
They don't seem to feel there's much to be gained from further deliberation, but the latest word is that they're about to announce their plans for tomorrow.
So, stay tuned tomorrow!!!!!
