Fitzgerald to Appellate Court: Send Scooter to prison.



Click to enlarge. Here is Fitzgerald's filing to appellate court today.

Fitzgerald's arguments are in three parts:

1. Defendant's Appointment Clause Claim. Fitzgerald reiterates the Morrison v. Olsen case.

2. Rulings Regarding Memory Defense.

3. Exclusion of testimony of reporter Andrea Mitchell.

In a nutshell, Fitzgerald reiterates the same rhetoric as he did in his filing to Judge Walton before Libby's sentencing. And he is Fitzgerald's bottomline. He writes:

Conclusion

"The government respectfully asks the defendant's application be denied."

I will be giving my thoughts in article on filings of Fitzgerald and Walton to Newsinkling.org next week. Basically, Scooter is hosed and finished. There is nothing more left to say regarding Fitzgerald's filing. His conclusion says it all. Have a great weekend!!!!

Fitz only had to repeat what he said in Court. Let's hope the Appeals Court follows the law and not the Bush Administration. Now all that's left is for the Gerbil to come in and give his pardon to his friend.
