Denied. That's what the U.S. Court of Appeals for the D.C. Circuit said today about the amicus brief filed in Scooter Libby's appeal of Judge Reggie Walton's decision last week denying him bail pending appeal. Click here to see filing.

This is what Libby was denied: Amicus curiae (plural amici curiae) is a legal Latin phrase, literally translated as "friend of the court", that refers to someone, not a party to a case, who volunteers to offer information on a point of law or some other aspect of the case to assist the court in deciding a matter before it.

From Libby's emergency appeal on Tuesday to the U.S. Court of Appeals for the D.C. Circuit:
The request will be considered by a three-judge panel of the court. By policy, the court does not disclose which judges are on the panel until a decision is made.
From today's filing from the appeals court, the names of the three-judge panel are revealed:
1. Number 47 Circuit Judge David B. Sentelle. He was appointed by Reagan.
2. Number 49 Circuit Judge Karen L. Henderson. She was appointed by George H. W. Bush
3. Number 52 Circuit Judge David S. Tatel. He was appointed by Clinton.
Update 2:
From the AP yesterday: The three judges said Wednesday that Fitzgerald has until Friday to respond to the request. The request is Libby's emergency for a get out of jail card to appeal his conviction. On a side note, The panel considering Libby‘s delay request is not necessarily the same panel that will hear the appeal of his conviction.

SPB how do you do it. Even the major stations and media don't have this Breaking News. Are you in the Court House. You always seem to get the information first.
It's good to see their are more honest Judges like Judge Walton who follow the law and not the Bush Administration. Now Libby will go to the birdhouse jail if Bush doesn't Pardon him. If Bush does Pardon Libby the American people will see how the System works for loyal convicted criminals in the Bush Administration. I hope no one give Libby soap as a gift. He'll go in jail as a little soldier and come out a woman. What a price to pay to save Dick Cheney.

Scooter didn't have a chance at the appeals court for an emergency get of free jail card to fight his appeal. Walton went straight by the law. System works. Scooter now has to depend of the President Gerbil and co-Presisent Dickster to pardon him. All eyes will be on the Gerbil. But, this news certainly shuts up and silences many of the nimrod media and the koolaid drinkers of the "free Scooter" lovefest.

If Scooter won at the Appeals Court, trust me, there would been breaking news, a Scooter lovefest, and the salvating of the media over this story. Of course, the appeals court didn't go into Scooter's favor.

It is good news and very quick decision from the appeals court. But, this leaves a very dark cloud for the WH on what move that they will make on Scooter. We are will be watching the Gerbil's decision. A very expensive court battle for Scooter and all for to CYA of his boss: the Dickster.

I was still updating the posting on more news on the latest on Scooter. But, it does look dim for the little soldier. So, hold off on the balloon until the day Scooter reports to prison. I posted more updates after both of your comments.
