This is the January 23, 2006 letter to Libby defense team. In the court document on January 31, 2006, Fitzgerald stated:
“We advise you that we have learned that not all email of the Office of the Vice President and the Executive Office of the President for certain time periods in 2003 was preserved through the normal archiving process on the White House computer system.”
Here is Fitz's court filing.
See Jason Leopold's articles on Truthout.org dated February 3, 2006 and April 18, 2007 for references.

Yes those famous lost emails will come back to destroy the White House. Fitz did his job and did it very well. Now Gonzo will have to deal with this corruption and his lies for as long as he holds on to his job. I'd love to be a lawyer now. Every client that I had I'd ask for a review of the paper work and if my client lied I use the Attorney General lying under oath to Congress as my defense. Yes Gonzo has made lying under oath legal and losing your memory is ok, even lying about lying is ok. I guess none of the DOJ lawyers will go to Gonzo for advise in a legal matter as we now know he's clue less. Now anyone can be Attorney General even me. I'd need a lunch break and 3 hour break to watch the soaps on TV.
