Theory of defense?


On TalkLeft.com, there was a piece of information that was intriguing. On January 19, 2007, the defense team filed a "theory of defense." In the filing, Libby denies that intended to lie, obstruct justice, and make false statements. He told the FBI and grand jury was honest recollections and his mistakes were unintentional. Defense have asked Judge Walton to read to the jurors as part of his instructions at the end of the case. Of course, a defendant is entitled to a "theory of defense" instruction, but there has to be evidence presented during the trial to support it. And from reading the filing, the defense team doesn't present evidence to support his defense. This is telling you where the defense is going in this trial.
